The Law on Disrepair and Good Practice

Aims:

This course is designed to:
— Examine implied & express covenants to repair,
— Clarify the various statutory responsibilities and procedures,
— Examine recent case law & its implications,
— Ensure delegates are aware of best practice.

Designed for:

All staff, including repair takers/administrative support staff, who need to understand the law as it relates to repairing obligations on landlords & tenants.

Key points:

— Common law requirements & the duty of care,
— S.11-16 Landlord & Tenant Act 1985,
— The importance of ‘statutory nuisance’ & the Environmental Protection Act 1990,
— Tenants’ obligations -”using the property in a tenant-like manner”, recharging,
— The disrepair ‘protocol’,
— Access to inspect and/or carry out repairs, including gas servicing.
